Restaurant restrained from using ‘Thalappakattu’

The Madras High Court has granted a limited order of injunction restraining Thalapakkattu Biriyani and fast food, temporarily called “Chennai Rowther Thalappakkattu Briyani”, Koyambedu, from using the name “Thalappakkattu” in any of the restaurants / shops opened after Nov. 19, 2008. It was on that date a consant order was passed by a Division Bench of the High Court. Passing an order on applications in civil suits filed by Thalappakatti Naidu Ananda Vilas Biriyani Hotel, Dindigul Justice V. Ramasubramanian said that in other words the defendent was entitled to use the name in respect of the four shops that were in existence as on Nov. 19, 2008 in the manner as agreed to before the Division Bench. But the benefit of the consent given by the plaintiff before the Bench would not be available to the defendent in respect of the shops opened after that date.
